Isn't this a bunch of nonsense? The taxes still get paid but they are paid by the individuals who exercise the stock options. If I am not mistaken, with the new Obama taxes that add the medicare tax, they could end up paying more taxes.

I believe Warren Buffet was behind this "tax loophole" because the EXCESSIVE options running about 2% for many tech companies are theft of wealth from shareholders that I believe should go to us as dividends but if our shareholder equity is going to be robbed by insiders, at least this way it shows up as a real deduction in earnings rather than hidden as it was in the past.
