The litigation against the tobacco companies was a class action suit where thousands of plaintiffs were lined up by thousands of lawyers and eventually combined into a few cases. That is what attracks lawyers to a class action suit. They get to multiply the awards by the thousands, but only have to do the work of one client. This case is completely different, ATP is in bankruptcy, the court is in control of their finances, not ATP. ATP cant spend a dime without court approval. Do you think the court is going to approve millions of dollars in legal fees on a case that, at it's heart blames BP for actions taken by the US government?

If the court wont approve such a deal, will some law firm big enough to take a flyer on this and assume all the costs of going up against BP in the hope of a big settlement or verdict on a simple contingency agreement? Would you bet $50-100MM of your own money that you could beat BP, it's deep pockets and it's lawyers in this case? I wouldnt.
