For whatever little it's worth I think it could be a 6-3 verdict.

My reading suggests there will be a majority for the "no standing" argument. Which, I gather, leaves the appeals court ruling standing, that is that Prop 8 was unconstitutional vis a vis California law.

I gather, from this, that a majority of justices don't wish to rule on the US Constitutionality question yet.
