The SEC has nothing to do with marginability. The Fed used to make all such decisions but under the Markets Improvement Act passed a year ago, an NMS listing now means automatic Fed approval for marginability. However, the ultimate decision is made by the actual lending institution, in this case E*Trade and Schwab. For more info on this, see: savoystocks.com.
