Yes and yes.

Also, check out any software package you own. I'll bet SBT's accounting software comes with a disclaimer that reads something like this: "This software and documentation is provided 'as is' without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the software is with you, and you assume the entire cost of all necessary servicing, repair or correction."

Shrink wrap warranties have not even been sufficiently tested in court for immediate use, let alone what might happen two years in the future.
