This is true, but if it is enforcable wouldnt you agree that it would loom rather large,especially with next generation boxes?Imagine the royalties :-)

Sie's Crystal Ball: HITS Won't Be Only Game in Town

DENVER - Programmers will have to fight for channel space on the digital dial, says John Sie. The wake- up call of '98 will be the realization that digital is not limitless, he says. "Digital won't be a panacea for unlimited channel space," the Encore Media Group chmn/CEO warned last year's Western attendees. He'll reiterate that admonition this week. The jockeying won't come from getting on national feeds like HITS, but from securing space on individual systems, who'll want to offer their own digital lineup instead of relying on HITS. New programmers with new ideas will run into the most impasses when looking for carriage, he says. "Without some franchise on the analog side it won't be easy for new ideas on the digital platform." He expects programmers like ESPN, Lifetime, which just announced its digital movie net, and Discovery, which offers a digital tier of channels, to have the most success landing digital slots. Thematic multiplexing, like Sie's channels launched in 1994, will be the name of the game. Digital cable will be available to 60mln HH by the end of the year and 30% of those homes will take the service, he predicts.
