I was thinking the same thing. Either he knows something or his statements can't be trusted. Dows anyone know if this guy has a history of being a straight shooter?

I'm sure this COULD NOT have happened if he wasn't looking at strong
evidence, i.e. signed contract, (probably handed to him as he took
his coat off on the first day).<<

I agree with your observation. Based on my experience in this profession, Ashby's statement that he is "comfortable" with Q4 and FY98 results would only be made if bookings (ie. contracts) support this. Otherwise, because of the pending lawsuit, he would have been advised by legal counsel to state that results are on track. I wouldn't be surprised of an upside surprise in Q4 earnings of between .26-.28 per share
