Yes, but without his ability to vote the 100,000,000 shares that the preferred represent, the Articles can only be changed by a general vote of the shareholders, at a meeting.

Watch for the proxy. If they want to increase the A/S, it'll have to be in there.

Without a new PIPE closed, though, it's all a bit moot.
