Of course he is. Anything to shut those damn conservatives up.

You'll only see him bitch once a Republican does it, but I guess he thinks the chances that the GOP will be elected in 2016 are low.

If they are doing what has been described so far it looks pretty harmless to me. Problem with these programs is there's always the rogue operators out there that will abuse the law and go out of bounds no matter who's in charge at the WH. That's does bother me...
