Maybe these words are only racist if the speaker or listener is racist?

If that is the case, you cannot say definitively that it wasn't racist unless you determine the state of mind of the person who said the word. When Trayvon used the word "cracker" it was a pejorative description based on his perception of Zimmerman's race. That makes it racist.

Do you think that Trayvon would use the word "cracker" to describe a black person?

And I think the "creepy-assed" modifier confirms the tone.

Is Paula Deen a racist because she uttered the n-word 30 years ago after being robbed by a black man? probably not. But was using the word racist? Absolutely. It was a pejorative word based on the person's race.
