It takes a balance. That is what society struggles with, the balance. We've moved well beyond any reasonable balance, with the ever expanding regulatory state. Hell, it is hard a heck to manage a small 30,000 population city. Esp. if you try to manage more and more aspects of it. Our early government was more libertarian and they found it didn't work and so they changed it! No it worked very well, and set the groundwork for our later prosperity. What didn't work so well was denying the freedom and full protection of the law from portions of society, but freeing people and providing for equal treatment under the law enhances liberty, it is not an anti-libertarian move.
