This is precisely the same as if the IRS decided to conduct individual income tax examinations of all persons with the last name "Kennedy". The left would be outraged, and they should.

Here is how the examination process works. The Internal Revenue Manual sets out specific guidelines for the way in which examinations are to be conducted. Revenue Agents are required to follow those guidelines. The reason for the guidelines is, in part, to assure consistent and measurable compliance. If rogue Revenue Agents are using criteria other than as provided in the IRM, you are not getting consistent practice. Any Revenue Agent or supervisor who was part of this intentional disregard of the IRM should be terminated immediately, and those entities who were incorrectly evaluated should receive an immediate re-evaluation by applying the guidelines under the IRM. The IRM also stipulates time frames during which various phases of the examination should occur. In this instance, the so-called "conservative" groups were denied adjudication in a timely manner. Unfortunately, there is no un-ringing of the bell on that and AFAIK.

While Revenue Agents can pose additional questions in the course of an examination, the questions that were asked in some cases were outside the scope of the examination and should never have been asked. This is what is commonly referred to as a "fishing expedition", and it is simply not allowed.

When the Revenue Agent (and his manager, who has to sign off on it) decides to deviate from the basic procedure outlined in the IRM, there has to be some reason for it.
