Don't know the exact details, which I read but can't recall. They should be available somewhere on the web and involve holding periods, etc. But, yes, the tax laws regarding shorting against the box have changed. It is certainly not "outlawed." Just under certain circumstances it is now considered a sale and capital gains would apply where they didn't before and using the tactic to defer capital gains tax doesn't work like before. Not sure how this would affect a Swiss company since this is US tax law.
