This is what we call a rogue gov't that is not held accountable to the people. It is precisely why we have a Constitution that the gov't must adhere to. It is to restrain them from abuses. NSA surveillance against American citizens is a violation of our Constitutional 4th Amendment rights, but the gov't is claiming that because they do it, it's ok. Hitler and his Nazis claimed legitimacy under the law as well. They basically said they can kill Jews because they're the government. That government was not legitimate. When a government acts against it's own people, then it ceases to be a legitimate government of, by, and for the people. Our Executive Branch is acting against it's own people. This is why we have a Judicial and Legislative Branch, to act as a check against overreach by the Executive. I eagerly await the day that our Judicial and Legislative Branch start exercising their Constitutional powers to restrain the Executive from all of their Constitutional abuses. In the mean time, I will vote against every President that violates our American rights. I voted against Bush for torture and shitting on the Constitution, among other things. I originally voted for Obama, but later against him for violations of the Constitution. I'll vote against any future President that does the same. We need to guard our freedoms and Constitutional rights jealously. "What manner of government have you bequeathed us, Mr Franklin?"..."A Republic, if you can keep it."
