That is a really unthoughtful reply to that example. While $3 million isn't much to McDonalds, it is a LOT for merely overheating the coffee and as compensation for the injury to one person. Had there been more who actually made it to court, the damages could easily have run 10x or 100x that amount.

Of course that happens; a client of mine had a claim against UPS and counsel recommended not pursuing it because for $20,000 you couldn't possibly come out on such a legal action. Nevertheless, the sheer volume of legal actions against business and the threat of them provides at least some level of de facto accountability for business.

No such accountability exists for government, for the most part.
