I don not think there is any restrictions on covering a short, but for a legal short, you have to do it on an uptick unless a company like Canaccord (who has around 300 brokers) probably have enough paper of a company kicking around to short on a downtick (they borrow someone else's, maybe yours, stock so sell short). It is normally illegal to short on the downtick, but can be done legally like the above example. It is a common practice.
