Found this over at the Ken Markus web site. Overall, not a positive. A question to those who are knowledgeable in this court area. I always thought that Iomega's strong position was due to patent protection - not because Nomai disks weren't as good. (My concern is that if that is the only problem, Nomai can come up with a better design.) Comments???

SUNNYVALE, Calif.--(BUSINESS WIRE)--Dec. 8,
1997--Nomai, after releasing the new XHD 100MB
floppy cartridge, has been faced with a temporary
restraining order from Iomega after a series of
ex-parte court actions between November 14 and
November 20 which took place in the USA, United
Kingdom and Germany.

Iomega claims the Nomai XHD is not compatible
to the Zip(TM) drive and may cause damage to the
drive.

Iomega's incompatibility claim is based on tests
which Iomega performed upon early hand-made,
pre-automated, pre-production cartridges built by
Nomai. These tests were also conducted using Zip
notebook drives which were just recently released
during Comdex Fall this past November. These new
notebook drives contain a light baffle which rejects
Nomai cartridges.

Nomai will be filing its response to Iomega's
ex-parte filing shortly. Nomai has retained two
leading independent testing laboratories which
tested current production product, side-by-side
with Iomega Zip cartridges. After rigorous testing
was conducted, the independent laboratories both
concluded the Nomai XHD cartridge performed
equivalently to the Iomega Zip cartridge.

In addition, Nomai has learned that C't Magazine
of Germany, by its own initiative and completely
independent of Nomai and Iomega, tested Nomai's
XHD cartridge. C't Magazine, after continuous
hours of testing, concluded the "XHD
works...perfectly with all SCSI, ATAPI and parallel
Zip drives". These drives constitute the current
installed base of the 10 million Zip drives that have
been sold to date.

Nomai will fight the Iomega ex-parte injunction. It
is confident that the injunction will be lifted in the
coming weeks after the different courts are given
the opportunity to see complete evidence. For press

RE: IOM today

I think IOM today has successfully completed the effect of barrons. Remember, last week we were all saying that it will go down. In fact, my post said it will drop to $30 and then up and up after that. I was
so disappointed last week that the shorts did not jump in after the Barrons article. Now i am all releived and i think $30 will hold as the support. Now i expect the Bulls to be back in business. (yes. i made use of this buying opportunity today ;-)

OK. guys. i am no TA expert and all my posts are just my personal experience of watching IOM for the past 2 years. So, don't shoot me if I am off a bit here ;-)

According to IR, Nomai Court decision is due out on or about Jan.23,1998.
