I've heard variants of that point numerous times, there is something to it but rent seeking, shady financial practices, etc. in general are not the same as a criminal act with a specific law against it, and a specified penalty of 20 or so years or more, and proof beyond all reasonable doubt.

If you have a specific example where all that comes together, maybe for that case I agree and might say toss the perp in prison for a long time. But mostly you just talk in general about tossing wall street people in prison. I'm not necessarily their biggest fan, but most of them don't deserve 20 year prison terms.
