Probably not. Post-9/11 there is a greater tendency to us SWAT teams and a general attitude of a"take no chances". Google "puppycide" sometimes.

Bottom line is that if a policeman feels threatened, even if that person is in a wheelchair with a knife, they are justified in shooting to kill. This guy did more than most, he had a firearm and has fired a weapon. There are lots of cases where people have been shot and had no weapon of any type. One guy was sitting in his car reading a book...
