If someone with access to Lexis, Westlaw or Pacer can get me a case style and case number of the No. Cal case, I'll obtain a copy of the complaint, maybe the request for TRO, etc. first thing tomorrow morning and we can take a look at the claims which are made. I believe the case is filed in San Jose or Palo Alto (probably U.S. District Court) I would imagine there are several levels of attack and this press release does not delve into all of them. Damage to the drives would be one thing, but what about patent infringement vis-a-vis the design. Again, I am not in position to do this at this time (supine again!)

Dale, the article also said...

In addition, Nomai has learned that C't Magazine of Germany, by its own initiative and completely independent of Nomai and Iomega, tested Nomai's XHD cartridge. C't Magazine, after continuous
hours of testing, concluded the ''XHD works...perfectly with all SCSI, ATAPI and parallel Zip drives''. These drives constitute the current installed base of the 10 million Zip drives that have been
sold to date.

So I went to C't Magazine's web site ix.de
I found nothing about the test. The only recent news they
had about Nomai was at ix.de

and dealt with the well known prohibitions imposed
on Nomai: "Verkauf von Noma‹s Zip-Disketten gestoppt"
(Sale of Nomai disks stopped).

C't has a few articles in English, but nothing pertinent.

Hope you all read the Nomai release carefully...

>Iomega's incompatibility claim is based on tests which Iomega performed upon early hand-made, pre-automated, pre-production cartridges built by Nomai. These tests were also conducted using Zip notebook drives which were just recently released during Comdex Fall this past November. These new notebook drives contain a light baffle which rejects Nomai cartridges.<<<<<<

Please note the last sentence. Nomai needs to fight Iomega in court and they need to try and be "forward compatible", which is most difficult.

I can see their packaging listing all of the Iomega drives that their disks won't work in. A marketeer's dream!
