He was charged criminally, but the prosecution was politically motivated as well as it was flawed.

Houston carjacking victim may not face charges for shooting attackers

Police said the owner of a gold-colored Pontiac sedan with decorative rims had pulled up to DVD movie-rental kiosk outside the McDonald's. He was apparently returning a movie at the kiosk when the suspects, who carried guns, confronted him. They demanded his car keys and cell phone and got into his car to drive away. A third suspect then sped away in a 1999 dark-green Honda Civic.

When the suspects began to leave in the man's car, the owner pulled out a gun and opened fire. The bullets smashed through the driver's side window and the windshield, wounding both suspects. Police said the car's owner has a license to carry a concealed handgun.

Police said one of the suspects, identified as 25-year-old Melvin Frederick Austin, died at the scene. The other suspect, identified as 32-year-old Elijah Alexander Mims, ran away after the gunfire. He was picked up by the third suspect who was driving the green Honda.

Mims was later dropped off at a hospital in College Station. Hospital staff alerted police about Mims and he was taken into custody. Police said Mims is charged with aggravated robbery with a deadly weapon. His gunshot wound is non life-threatening.

Resident shoots man during home invasion in NE Houston

A Houston resident shot and wounded a man during a home invasion early Friday morning in northeast Houston.

The shooting happened about 3 a.m., at the house on Melborune near the Eastex Freeway, according to the Houston Police Department.

Police said the suspect, whose name has not been released, was rushed to a nearby hospital. Details of his wound and condition were not released.

Police had little information so far about the case. Investigators said the resident apparently saw the man trying to get into his home, grabbed a gun and opened fire.
