I'm not a patent lawyer, but, I don't think its competely accurate to describe the judges ruling as being based upon a "technicality". If I read the material that came out at the time correctly, the judge was saying that AXC made certain arguments associated with obtaining the patent which it contradicted in its patent infringment suit. I'm sure there's someone out there who can better explain this and would love to stand corrected, but, as I read it there seemed to be a solid logic behind the ruling...
