My understanding is that the EPA can require BACT - best available control technology. What that is will be the legal issue.

It is actually irrelevant. What company would want to fight it. The only people to suffer will be the workers in the coal industry. The power plant companies do not give a damn as they can simply pass along costs to their rate base. Watch Joe Manchin in the Senate. If he really wants attention he can declare himself an Independent and not caucus with Harry.

The legality of BACT will not matter a lick. The end of the construction of new coal plants has come. I suspect that are numerous ones still under construction that will come into to operation.

Congress someday will act to limit the Imperial EPA which can rule by fiat.
