Chief Justice John Roberts is no where near as bad as President GHW Bush's nominee David Souter who became a reliable leftist vote.

There may have been method to his madness.

The Commerce Clause was out of control, and he at the very least has stopped that bleeding.

Some would argue that it does little good after the Obamacare horse was out of the barn. But it isn't clear that that is the case. There are hundreds of cases still pending against Obamacare, and at least a couple that could kill it dead.

The Origination Clause case, litigated by Pacific Legal Foundation, seems as though it could be promising. Roberts had to know the opportunity to hear that case after the last decision converted the legislation into de facto tax legislation that illegally originated in the Senate. It may be another year and and half before it is heard, but it has the potential to totally strike the ACA down.

Which is better? Killing the Commerce Clause THEN killing Obamacare, or just killing Obamacare, which is what might otherwise have happened?
