Well, when someone buys a website that ran like a perfectly oiled machine and then systematically destroys it until it is no longer even a shell of it's former self, I suppose TOU goes out the window too. Oh. Gotta keep it zen. Ohhhhhm.

re: "I don't recall that "negativism" is a tou offense." To be as positive as I can, it would seem that the new owner has a new edition of the TOU's. He just hasn't had a chance to publish them yet. But Dmitry is doing an excellent job enforcing them.
