NANNY STATE ALERT: FDA to ban trans fats by regulatory fiat, without an act of Congress The FDA has just announced that it will order a ban on trans fats on Thursday. The measure has not been passed through any legislative body. It is law by fiat, a nanny state completely out of control. from NBC: The Food and Drug Administration has declared war on trans fats. The government agency said Thursday it would require food makers to gradually phase out artificial trans fats — the artery-clogging ingredient found in crackers, cookies, pizza and many other baked goods. The change could potentially prevent 20,000 heart attacks a year and 7,000 deaths, said FDA commissioner Margaret Hamburg. While the amount of trans fats consumed by Americans has dropped dramatically over the last decade, they still “remain an area of significant public health concern,” Hamburg said during a press conference Thursday. The FDA hasn’t yet set a time table for sweeping trans fats from the market. “We want to do it in a way that doesn’t unduly disrupt markets,” said Michael Taylor, FDA’s deputy commissioner for foods. Still, the “industry has demonstrated that it is by and large feasible to do.” read the rest Once again, the Obama administration is using regulatory bodies to bypass Congress and rule by proclamation. It is unacceptable, and I hope some patriot restauranteur takes the FDA to court over this. We cannot allow the Executive branch to issue what is essentially new law with zero checks and balances from the Legislative branch whose job it is to write laws. Here’s the truth: nobody is forcing anybody to eat trans fats. Nobody. If people choose to eat artery clogging burgers and fries because they taste delicious, that should be completely up to them.
