Universal Criticizes Kirch/Bertelsmann Tie-Up
The planned digital TV merger between long-time rivals Bertelsmann AG and Kirch Group may have hit a snag Tuesday, thanks to a lengthy memo criticizing the play submitted by Universal Studios to the European Commission's merger task force. Spokesmen for the EC did not reveal the content of the memo, which totaled some 50 pages, saying only that it criticized the merger and that it was one of several complaints from digital TV competitors. Universal is expected to comment on the memo later this week.

In addition, the EC is still digesting a response from Bertelsmann and Kirch to a recent order sent to the two companies instructing them to cease marketing a Kirch-owned digital TV box or risk heavy fines. The EC also would say only that the reply was "long" and that both the EC and the companies would likely comment further in coming days. The EC has until January 2 to clear the merger between the digital television giants.

The so-called d-box is marketed by pay-TV venture Premiere, which is jointly owned by the two media giants.
