conjunction with the complaint about patent infringement after disks were available to check.<<

JMJ -

Well, I haven't seen the entire text of the injunction, but here's an excerpt:

Iomega Corp. (NYSE:IOM) announced that on Nov. 20, 1997, the U.S. District Court for the Northern District of California granted Iomega a temporary restraining order against Nomai S.A. and its U.S. subsidiary, Nomus Inc. The order restrains Nomai and Nomus from "making, selling, offering for sale, using, importing, or distributing Nomai's XHD cartridges in the United States which claim on their labeling or packaging that Nomai's XHD cartridges are compatible Iomega(R) Zip(TM) disks or are compatible with Zip drives or disks."

I read this as meaning that the injunction is based on claims of compatibility being misleading or fraudulent. Perhaps this is because it was possible to get this ruling more quickly, based on the results of testing by two independent laboratories hired by Iomega. BTW, the tests Iomega commissioned were not done solely on the new notebook Zip drives, but also on some internal drives.

I'd really like to see some sort of ruling on patent claims.

Meanwhile, I am actually getting somewhat nervous about screwing up my drives using these disks. Precisely what Iomega would want, I'm sure. But in my earnest search for the truth, I will not be swayed.
