Stockpiles at the new plant? I am not sure of that one. You can bet they have produced product, and a number of days of it prior to opening it up for inspection. I am not sure on this one (the company I worked with may have fudged). They could have moved the product back to the old plant for shipment, however I'm not sure that would be okay with the FDA. Anyone know the rules on this one?

If product was not moved back to the old plant, then we know there is product at the new plant. They just can't ship it this QTR. Kind of like a mining co (gold comes to mind) producing, but not shipping until the next quarter.

I hope management has their head screwed on tight enough to have this all worked out. We know the product works, we know they can produce product, we know they are bringing new plant(s) on line, it seems the question is management.

If you don't trust the mangement - get out of the stock.

I am still in. IMHO

<<A very sleepless night indeed. I feel certain Vivus will recover if management has been truthful about the shortfall. This may be the buy of a lifetime.>>

I agree 100%, but the market perception must reflect management's truthfulness regarding the shortfall and the reasons why VVUS may be the buy of a lifetime. I'm fairly convinced that they did not fully forsee the incredible damage to the share price the announcement created. They have a fairly limited window to do damage control and show us what they are made of in the face of true adversity. Similar to what I heard the Zona CEO had to do when Asensio went after his company a few days ago.

Take care,

Frostman

If they haven't been truthful they're the ones who'll have some sleepless nights. They'll be sued into the ground.
