Congress/democracy can pass a law outlawing gay marriage.
And then it would get shot down in the Supreme Court.

You know, because the Supreme Court is appointed to interpret the Constitution. In this case, the SC would call out the equal protection clause.

Of course you consider the Constitution to be an archaic document. (Which is funny, since if that were the case, we wouldn't need the judicial branch of government.)
