The interesting thing is that the defendants could have made what might be construed to be a useful objections to the work if they had simply said the tree ring data should be considered unreliable, due to the anomaly in the one data set that diverged during the instrumental record. But they didn't do that, instead, they wanted the anomaly included when the details of why it was not included had been worked out. They then accused the scientists of fraud, when there was a published paper detailing why it was done.
