The merger agreement was not contingent on the loan.

In response to the statement about the equity funding shares, FWIW, Breton told me on Tuesday that all the shares were restricted for at least two years.

The equity funding clause was between RMCW and RMIL. This simple extension agreement would only state that the two parties agree upon the extension, and with spell check not a problem. If the other party had signed a final agreement, the equity funding clause would have been included in the final agreement to guarantee their position.
