This is a liberal lie.

The suit, apparently, makes no reference to fracking at all. And in fact, is a lawsuit about whether a 160 ft tall water tower should be built in an area in which zoning specifically prohibited such construction, and that zoning on which purchasers of expensive adjacent property based their decisions. In fact, it has nothing at all to do with fracking.

The story reveals the headline is a lie. He's objecting to the site of a water tower.
