Bartonville residents: We are a group of Bartonville citizens that are interested in the FACTS, not opinions of those who claim to represent our interests. We are concerned in the recent newsletter from the CURE group represented by Del Knowler. This e-mail is in response to the misleading information the he communicated. While it is accurate that, to date, the town has spent approximately $200,000 of our tax money in this law suit, it is not clear how much Bartonville Water Supply (now known as Cross timbers Water Supply) has spent as they do not publish this information. The reason this money was spent is Bartonville Water Supply SUED our town. The council is simply defending what the citizens wanted. That was not to allow Bartonville Water Supply to build an additional water tower in OUR town. When council denied the permit a few years ago to build a water tower, it was because of the will of the citizens who overwhelmingly spoke at two council meetings against it. Only one town citizen spoke in favor for it versus the dozens and dozens of citizens and businesss owners who spoke against it. Mr. Knowler also claims that the law suit is now cloudy and that the suit has been sent to the Texas Supreme Court. Once again, this is inaccurate and false. A few months ago, the Texas Court of Appeals ruled in favor of the Town Of Bartonville and placed a stay on the construction of the water tower. This is why construction has halted and left unfinished. Bartonville Water Supply has asked for a reconsideration of the verdict from the Court of Appeals, but they are currently in recess. While you can never completely predict what a court may do, Bartonville Water Supply did not include any new evidence in their request and there appears to be no reason to believe that the court will change their verdict. TO DATE, THERE IS NO LAWSUIT SUBMITTED TO THE TEXAS SUPREME COURT. Mr. Knowler has misled you here. Lastly, the Town of Bartonville administration HAS NOT contacted the County Election Board on the topics listed below in his e-mail. The only submission made to the Election Board is for the special election for this November to fill the two vacancies on the council. By law, Bartonville Town Hall does not have the authority to register voters. However, you may obtain a voter registration card there and mail it in to the Voter Registrar. Bartonville Town Hall has not contacted the Election board for any other reason. Feel free to contact any of your town officials or the Bartonville Town Hall to verify this information. Bartonville does not believe Cross Timbers Water Supply has the right or need to erect a new water tower in the town. The legal action began approximately three years ago. It is estimated the town and the water company have spent $400,000-$500,000 to date for legal fees. A portion of the suit has been submitted to the State Supreme Court. The costs continue to climb. Dick Armey and his neighbors have filed a separate lawsuit against Cross Timbers Water Supply Corporation. Their lawsuit is based on aesthetic aspects and possible effect on property values. The town's lawsuit has recently been clouded by discovery of an error where pertinent information was not officially entered into the town ordinances. Present administrative staff did not cause this problem. Worst case, the court actions could start over with little value received from the money spent. Perhaps the council needs to take another look at this to determine what the town does next – withdraw from the lawsuit or continue to support it. This decision needs to be made in the near future as it affects present and future budgets. We were pleased to learn that Bartonville administration has contacted the County Election Office and has requested the following: 1. Authority to register new voters at town hall 2. The unsigned response from bartonvilleinformant@gmail.com suggests that the CURE information is misleading. Our information is accurate and verified. We are not taking a position on the water tower, only that the citizens of Bartonville should be aware of the expenses they are incurring. Hundreds of thousands of dollars is too large an amount to ignore for a small community.
Bartonville informant also indicated that no action has been filed with the Texas Supreme Court. This is incorrect and our original statement is true. Bartonville Water Supply Corporation filed a Petition for Writ of Mandamus with the Texas Supreme Court on June 28, 2013. The case number is 13-0490 and can be found on the Texas Supreme Court website at www.txcourts.gov.
The informant also stated that the town has not contacted the County Elections Board with regard to early voting and voting equipment. We obtained that information directly from the Denton County Election Board. On July 18, I spoke with Bartonville town secretary who confirmed that the town has taken steps to arrange for early voting, will have new voter registration forms, and has ordered voting machines for the election.
Soon after CURE's establishment, it was criticized for not having an identified spokesman. I volunteered to be that spokesman. It seems to me that if the Bartonville informant is the organization it claims to be, it should do the same.

Now not only is this representative of CURE just posting bad information, he is communicating false and private information about the mediation between Crosstimbers Water Supply and the Town of Bartonville. We wonder how he gained this information??? Who told him this information??? Could it be that he is buddies with some of the people at Crosstimbers Water Supply???? Someone told him something he should not know and he communicated it to the public, thus spreading FALSE AND ILLEGAL INFORMATION.
He has now created a terrible situation. He now may have cost both the Town of Bartonville AND Crosstimbers Water Supply more legal expenses!!!!
Stop trying to run the town Mr. Knowler. That is what the eleccted officials are for. If you want to be in charge of the town, then run for Mayor!!!! Once again the anonymous Bartonville Informant, who will not identify themselves, has resorted to slanderous remarks as a tactic. I furnish my name and make every effort to substantiate statements made by Citizens United for a Rural Environment (CURE). The problem is there are people such as the Informant who do not want an informed and participating citizenry disagreeing with their agenda. The last election with a 70% advantage over the incumbents clearly stated the citizens wanted a change.
I challenge the anonymous informant to stand up and meet me in person to discuss what he/she claims to be lies. If he/she has sufficient proof, we will print a retraction. The informant knows my phone number. As to CURE costing the town money on the Desist Order, this should not be the case as it was filed by the Armey group and the town need not be involved.
CURE wants the majority of the citizens to have precedent and the council take appropriate action. When this is accomplished, there is no reason for CURE and me to be involved.

Mr. Knowler,
We know your tactics. There is no debate here. YOU published private and confidential information that YOU received from someone at Crosstimbers Water Supply. Because YOU did this, mediation has halted and YOU have cost boh the Town of Bartonville AND Crosstimbers Water Supply time and money!
