CJ, the point about the smallpox is that almost all of the Native deaths due to smallpox and other foreign diseases were not the result of some vast conspiracy by the white man. Only after the effects were seen did some think to use it as a weapon, and even in the one documented case, it wasn't effective at all. As for the letters showing intent, if that's all that was required to prove genocide, then Native Americans would also be guilty of "genocide" against the white man, given that they too intended on driving all of them off of their lands.
