They had the authority, but if it turns out the hospital can't get reimbursed for it then they may also have accountability for it.

When my mom died I could not get the ER physician to admit her. It happened during an ice storm when there was no place in town with heat except the hospital and the ER doc refused to admit her because "she's dying and we can't help her." In spite of the fact that she had spent the previous night in her assisted living apartment without heat, in and out of consciousness. After nearly 8 miserable hours in the ER I got another doc to admit her.

The ER doc didn't want to take responsibility for admitting a patient who couldn't be helped. The doc who eventually admitted her was not a hospital employee but was bulletproof if the hospital complained.

These are complicated issues and you're trying to make it black-and-white. It isn't.
