Charter schools by definition are public schools which receive public money and are regulated by the state educational authorities, so no, not just anyone can set one up. Wikipedia had a decent overview here - en.wikipedia.org

My one experience with a charter school was in Red Bank NJ where we lived at the time. It was created by parents and educators who had been trying for 30 years to improve the town primary and middle schools, with no success. The Red Bank students simply could not compete with the students from the two other towns attending the regional high school.

RBCS would NOT have been created had the local school board and admins been doing their jobs. It involves an enormous amount of time and effort to apply to the state, and then actually rent space, hire staff, develop curriculum, etc. Instead of improving their schools, the RB educational poobahs fought the charter school every step of the way, and lost. And you know what? After they had actual competition, the primary and middle schools finally started to address their own problems to keep their students from going elsewhere.

BTW, Red Bank was known for being a "5 years and out" town. Great for singles and young couples, but the people who wanted a good education for their kids moved elsewhere, along with the people who didn't want their kids in the same schools with so many blacks and HIspanics (I knew a few of those).
