In general, it does seem stupid to me if you have been busted twice to put yourself in the position of possibly losing your freedom by smoking marijuana in a place where they'll put you in prison if you're caught doing it.

OTOH, when the previous two arrests were 8 and 20 years ago, the idea that one might be labeled an "habitual offender" seems strange when the offense is so minor.

It is just stupid all the way around imo.
