Yes, that's true.

And that is a recognition by drug courts across the country that treatment is a better option than jail. Unfortunately, there will have been lawyers, judges, lots of money, jails, and criminal records all leading up to what is the best possible outcome anyway -- drug treatment.

Also, the court-ordered programs are lousy because there is no money for them. Which there would be if you fixed the basic problem.

I think you could continue to have marijuana and other drugs be illegal if you had a guaranteed out that involved state-paid drug treatment as an alternative, with the elimination of all arrest records and other negative consequences for someone who chose treatment. Something along those lines would still maintain some control over the process while allowing people to choose a more sensible way out as long as there was no violence or other crime associated with it.
