The Judge will make the final decision. From what I have read, the ruling is only a preliminary injunction as opposed to permanent. Personally, I think this whole deal is a non-event. IMO when everything settles out, MSFT will be allowed to bundle the browser with the OS to those OEMs who want both. If the browser is thrown in at no additional cost (or slight add'l cost) why wouldn't the OEM want it? No doubt MSFT has the best attorneys money can buy so I don't think MSFT will be treated unfairly in the Courts. MSFT can always appeal if it does not agree with the final ruling. I do not presently own MSFT or NSCP so I don't have a finacial stake in the matter. I doubt if MSFT is going to suffer one way or the other. NSCP might benefit slightly. NSCP's stock price went up quite a bit at the open but backed off significantly from its daily high.
