I think that's pretty much exactly what I said:

"It has been illegal for decades and to the extent it does happen it happens in spite of insane regulatory threats."

It is illegal, yet you are claiming it happens on occasion. If someone can prove it happened, there are a thousand lawyers ready to take the case on a contingency. If they can't prove it happened, well, that's the result of trying to legislate something that is inherently difficult to legislate. The net result is one more regulation that causes the cost of hiring to go up and yet another good reason to prefer automation over humans, and even more people on welfare.
