It allows employers to NOT establish any 401(k), of course. It does NOT allow you to have a 401(k) for some people and not for others.

So, minimum wage employers like McDs and Walmart commonly offer 401(k)s. And the lowest paid minimum wage employee is just as eligible as the highest paid management people.
