They're not really "tax breaks". Long-term capital gain treatment is what it is for good reason; it is necessary when you have a graduated tax rate schedule with an annual reporting period to avoid unfair taxation of investment income.

There are some areas that are problematic, like section 121 treatment of gains on sale of a residence. It is a nice break, but there is really no reason for allowing the one-time exclusion of capital gains that probably ought to be taxable.

But for the most part, the capital gain provisions make a lot of sense.

As to business investment, we ought to be trying to find ways to make it more attractive.
