I thought it was too complicated for me to get the ordinary shares and deal with. Presumably you would have rights as a minority shareholder depending on the regulations there. Since it would have been a hassle to get the shares and try to sell them (and I had no other reason to hold them as I had no interest in trying to to maintain a minority ownership interest).

Gentium had a filing where they indicated the ADR's would be stopped (I don't recall the exact wording). I believe it was with that filing that they indicated the depository would sell the underlying shares (presumably back to the company at the current offer price) and the cash proceeds (less expenses) would be returned to the ADR holders. In a Jazz filing they indicated they would buy back the shares at a price not less than 57 a share (that made me feel comfortable holding even knowing the ADR would stop trading).
