The Redskins fought the same thing in 1992 and prevailed for the same reason. At the time the trademark was obtained it was not disparaging. I'm not doing a lot of legal research to satisfy you unless you are willing to pay me by the hour. Take a look at the NAACP for example. They trademarked their name. I find the name Colored offensive, make them change their name. You can't because it wasn't derogatory at the time the name was trademarked. Same thing with Aunt Jemima Pancake Syrup. The list goes on and on including the Navajo nation naming their High School Football Teams, Redskins.
