The ban on polygamy among those who have deeply held religious views has been ruled unconstitutional by a federal judge. Until such time as it is heard in the Supreme Court that will be the law I suspect.

There is no doubt it is, and forever has been, unconstitutional to ban polygamy. The 1800s decision which relied on the Common Law was wrongly decided and would almost surely be overturned if it came before the Court today.
