A non-legal expert opinion: the U.S. Constitution always takes precedence over state laws. A case can be sent to a federal judge if someone thinks it involves a federal constitutional issue. The U.S. judge would decide if there is a federal issue involved. If he can't find a federal constitutional issue, then the clause about "all other issues not enumerated in the Constitution belong to the States" (my words) would apply.

It's the same logic the U.S. Supreme Court applies when it refuses to hear a case sent up by a State Attorney-General.

How long it takes, I have no idea.
