Obama is certainly within his rights to excuse any fines imposed by the Govt. on those who have not complied with the requirements of Obamacare. Or else explain "Presidential pardon" He/soon to be a she does not have to get Congressional approval for those pardons. These folks like Boehner are barking up a wrong tree.
