..neither of the courts have heard the case en banc

...and there is little doubt that once either of them take this up, as a whole, that Bush appointed tag team will be sent to remedial judge school..

...and it will certainly never go before the CSCOTUS again

Roberts already had a near nervous breakdown being forced to render the tiebreaker vote that he hoped would protect his namesake court from surpassing the Dred Scott court as the most vile in history

Pretty sure that if there is even a hint of that turd going back for nits like this, Roberts will refuse to let it back in the door

They have ruled that the ACA is Constitutional

,,,the boys on the lower benches will just have to figure out who they need to slap to keep it so

It's a bit early in the book to see that as the end chapter. We still have to see if the full courts in each circuit will weigh in. I expect the DC court to overrule the 2 to 1 vote; and the 4th circuit to approve the 3 zip vote.

That leaves the right wing of the SC in a huge quandary, one that Roberts will be looking for a way out.

But it's sufficiently early to not be able to tell how the politics will stack up for Roberts.
