The legislation was drafted by folks operating under the assumption that rational decisions on its deployment would be made

It was obviously an oversight to not write it in a way that factored in the fact that Republicans would be more willing to deprive their citizens of health coverage than allow Obama to get credit for partially yanking the US into the 20th century....never mind the 21st..

If the federal exchange was in the legislation as passed by Congress, then I don't see how this challenge has a leg to stand on. The federal exchange would have no purpose if the tax credits weren't available through it. The only function of the exchanges (state or federal) is the credit. The "shopping convenience" angle didn't prove to be the case.
